Benlate, containing the active ingredient benomyl, is a discontinued fungicide manufactured by the DuPont Co. and introduced in 1970. Benlate was first linked to problems in 1989 when Dupont temporarily recalled the product due to the presence of atrazine, a herbicide restricted by the EPA because of its link to serious health problems including heart, liver and kidney damage and birth defects. Immediately following its recall, farmers began filing lawsuits against DuPont alleging Benlate caused extensive crop damage. Dupont, which ended Benlate production in late 2001, insists the fungicide is safe, noting its production was halted due to overwhelming legal costs.
Still, studies have shown that exposure to Benlate in the first trimester of pregnancy could cause anopthalmia (no eyes) or microphthalmia (small eyes) in the fetus, meaning the fetus would not fully develop or develop anything at all in their eye cavities. As long ago as 1972, the EPA advised that DuPont should put a label on Benlate warning that it could cause birth defects and exposure during pregnancy should be avoided. But lobbying from DuPont persuaded the EPA that the warning was misleading and unnecessary.
The Benlate attorneys of James F. Humphreys & Associates insist victims of Benlate exposure are compensated for their suffering. Benlate is not safe and our firm can help to protect your legal rights if you have been affected by this dangerous fungicide.
